No other proof is required for a district court to enter final judgment on the penalty. Only nineteen of the 309 Texas cities of more than 5,000 population have not adopted a home-rule charter. Of the 290 charters in existence in May 1994, 251 called for the council-manager form of government, 39 for the mayor-council form, and none for the commission form, which was initiated in Galveston in 1901. A person who is found by a hearing officer to have violated an ordinance may appeal the determination by filing a petition in municipal court before the 31st day after the date the hearing officer's determination is filed. The next step is for the city secretary to verify that the signatories are registered voters in the city. If the petition is deemed valid, the city government can either adopt the ordinance or hold an election on the proposed ordinance. This process allows residents to propose legislation themselves, if the city government has not opted to act in some regard. First, citizens must gather signatures on a petition for such a measure, which would include text for a proposed ordinance. Just how many signatures will vary by home rule charter; some might be a particular number of voters and others are calculated by some proportion of votes cast in a prior generation election.

The requirement imposed by Subsection does not waive governmental immunity for any purpose and a person may not seek injunctive relief or any other judicial remedy to enforce the estimate of the anticipated fiscal impact on the municipality. Residents of home rule cities in Texas are afforded some ability, under certain circumstances, to force their city government to act on measures the government might not have undertaken on its own. An item or vehicle is deceptively similar to a police identification item or patrol vehicle of a municipal police department if the circumstances under which the object is used could mislead a reasonable person as to the object's identity. The marshal or a deputy marshal shall be available to the municipal court when it is in session and shall promptly and faithfully execute writs and process issued by the court.

What Does "Home Rule Municipality" Mean?

The individual or committee shall sell the seized land if the assessment is not paid before the day of the sale. The municipality shall give the same notice of the sale that is required to be given in other sales to collect delinquent taxes. The sale is subject to the same ordinance provisions that govern the name, circumstances, and conditions under which a sale of land may be made and the extent to which a sale may be made to collect delinquent taxes owed the municipality. The individual or committee shall execute a deed to the purchaser at the sale.

A vacancy is filled in the same manner as a vacancy among the regular members. This subchapter does not affect the power of a court to imprison a person for contempt of valid court orders or the availability of remedies or procedures for the collection of a judgment assessing civil penalties. The remedies under Section 31.002, Civil Practice and Remedies Code, are preserved. If a governmental entity complies with this section and does not receive an affidavit under Subsection , the record owner is presumed to be the owner of the property for all purposes to which the notice relates. If the governmental entity receives an affidavit under Subsection , the governmental entity shall send the appropriate notice to the person named in the affidavit as having acquired the property. A notice sent under this subsection must include the statement authorized by Subsection .

Home rule in the United States

Just as home rule cities can make many of their own decisions, their residents too have some recourse to change how they are governed. This form of self-determination is not available in other Lone Star state locales and manifests itself in four particular democratic procedures applicable in home rule cities. The record owner shall deliver the affidavit in person or by certified mail, return receipt requested, to the governmental entity not later than the 20th day after the date the record owner receives the notice. In Texas, cities are either "general law" or "home rule" cities. Cities governed under general law have only specific powers granted by state law.

The commission may file notice of a proceeding before a commission panel in the Official Public Records of Real Property in the county in which the affected property is located. Luckily, Jersey Village is a home rule city, which grants it wide latitude under Texas law to allow local citizens to govern their city the way they wish. Rather than being told by the state what they can do, the state only defines what a home rule city cannot do. If there is no prohibition in state law or in the state constitution, the city government may do anything consistent with its charter and ordinances.

Indeed, the Texas Supreme Court found that the Election Code expressly allows home-rule cities to establish their own requirements in municipal elections. Having so concluded, the Court found the city’s provision regarding election deadlines is the provision that must be applied. In light of this immense power, it is disheartening to know that voter turnout for municipal elections in Jersey Village is shockingly low. In May 2015, only 331 out of approximately 5,000 registered voters cast a ballot in the last municipal election.
